2. Services Description
Anushka provides comprehensive IT services including but not limited to:
- Custom software development

- Cloud computing and DevOps solutions
- Cybersecurity services
- UI/UX design services
- IT consulting and strategy
- Maintenance and support services
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3. Service Scope and Disclaimers
3.1 Service Limitations
Our services are provided "as is" and "as available." We do not guarantee that our services will be uninterrupted, error-free, or meet your specific requirements. Service outcomes may vary based on project complexity, client cooperation, and external factors.
3.2 Technical Requirements
Clients are responsible for providing necessary technical specifications, requirements, and access to required systems. We are not liable for delays or issues caused by inadequate client information or system access.
3.3 Third-Party Dependencies
Our services may depend on third-party platforms, APIs, or services. We are not responsible for the availability, performance, or changes to these third-party services.
4. Quotations and Proposals
4.1 Proposal Validity
All quotations and proposals are valid for 30 days from the date of issue unless otherwise specified. Prices and terms are subject to change after this period.
4.2 Project Requirements
Quotations are based on the information provided at the time of proposal. Additional requirements or changes may result in revised pricing and timelines.
4.3 Acceptance
Proposals are considered accepted when you provide written confirmation or make the initial payment as specified in the proposal.
5. Payment Terms
5.1 Payment Schedule
Payment terms are specified in individual project proposals. Typical payment schedules include:
- 50% upfront payment upon project initiation
- 25% at project milestone completion
- 25% upon project delivery and acceptance
5.2 Payment Methods
We accept payments through bank transfers, online payment gateways, and other mutually agreed methods. All payments must be made in Indian Rupees (INR) unless otherwise specified.
5.3 Late Payments
Late payments may result in project suspension and additional charges. We reserve the right to charge interest on overdue amounts at the rate of 18% per annum.
6. Intellectual Property Rights
6.1 Client Ownership
Upon full payment, clients own the final deliverables created specifically for their project. This includes custom code, designs, and documentation developed exclusively for the client.
6.2 Company Rights
We retain ownership of:
- Proprietary frameworks and libraries
- Reusable code components
- Design templates and patterns
- Internal tools and methodologies
6.3 Third-Party Licenses
Clients are responsible for obtaining and maintaining licenses for any third-party software, libraries, or services used in their projects.
7. Warranties and Liability
7.1 Service Warranty
We provide a 30-day warranty period for all deliverables. During this period, we will fix any defects or issues caused by our development work at no additional cost.
7.2 Limitation of Liability
Our total liability for any claims arising from our services is limited to the amount paid by the client for the specific service in question. We are not liable for:
- Indirect or consequential damages
- Loss of profits or business opportunities
- Data loss or corruption
- Third-party actions or failures
7.3 Force Majeure
We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, government actions, or technical infrastructure failures.
8. Support and Maintenance
8.1 Post-Delivery Support
We provide 30 days of post-delivery support for all projects. Additional support and maintenance services are available through separate agreements.
8.2 Support Scope
Support services cover bug fixes, minor adjustments, and basic troubleshooting. Major modifications or new features require separate project agreements.
8.3 Response Times
Support response times vary based on the support package selected. Emergency support is available for critical issues during business hours.
9. Confidentiality and Data Protection
9.1 Confidential Information
We maintain strict confidentiality of all client information, business data, and project details. Confidential information is shared only with team members directly involved in the project.
9.2 Data Security
We implement appropriate security measures to protect client data. However, clients are responsible for backing up their own data and ensuring compliance with applicable data protection laws.
9.3 Privacy
Our data handling practices are governed by our Privacy Policy, which forms part of these Terms and Conditions.
10. Project Management and Communication
10.1 Project Communication
We maintain regular communication throughout the project lifecycle. Clients are expected to provide timely feedback and respond to project-related inquiries.
10.2 Change Management
Project scope changes must be documented and may affect timelines and costs. We will provide impact assessments for any requested changes.
10.3 Project Delays
While we strive to meet project deadlines, delays may occur due to client feedback delays, scope changes, or technical challenges. We will communicate any anticipated delays promptly.
11. Termination and Cancellation
11.1 Client Termination
Clients may terminate projects with written notice. Termination fees may apply based on work completed and project stage.
11.2 Company Termination
We may terminate services for:
- Non-payment of fees
- Breach of these terms
- Unreasonable client demands
- Force majeure circumstances
11.3 Post-Termination
Upon termination, we will deliver all completed work and provide project documentation. Final payments are due within 15 days of termination.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.
12.2 Dispute Resolution
We encourage amicable resolution of disputes through direct communication. If disputes cannot be resolved, they will be subject to mediation or legal proceedings as appropriate.
12.3 Arbitration
Any disputes may be resolved through binding arbitration in Jaipur, Rajasthan, in accordance with the Arbitration and Conciliation Act, 1996.
13. Amendments and Updates
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of updated terms.
Material changes will be communicated to active clients through email or other appropriate channels.
